Legal Information and Acceptance

This Legal Notice regulates the use of the service of the website: www.signe.es (hereinafter the “Website”), operated by SIGNE, S.A. (hereinafter “SIGNE”) a Spanish company, with CIF (Tax Identification Code) A11029279 and an address at Avenida de la Industria, 18, 28760-Tres Cantos (Madrid), and made available to internet users. The use of the Website confers the status of user, (hereinafter, the “User”) and implies the acceptance of all standards of use contained in this Legal Notice.

 

The acceptance of this Legal Notice implies that the User is familiar with these terms and commits to fulfil them. Under no circumstances does SIGNE guarantee the availability or maintenance, in the future, of the services accessible via the Website. Furthermore, SIGNE may, at any time, decide to interrupt, suspend or definitively cancel the Website, with no compensation or reparation for the Users.

 

Intellectual and Industrial Property

All of the elements (hereinafter “Elements”) that form part of the Website (including but not limited to the images, sound, audio, video, software or text; brands or logos, colour combinations, structure and design, selection of materials used, software necessary for functioning, access and use, etc.) are owned by SIGNE or by their collaborators and are protected by the corresponding intellectual and industrial property right.

 

The use of the contents must respect the specific licensing. Therefore, its use, reproduction, distribution, public communication, transformation or any other similar or analogous activity is strictly prohibited except where the prior express authorisation of SIGNE is granted.

 

SIGNE authorises the full or partial reproduction of the texts and content provided on the website, provided that all of the following conditions are met:

 

The integrity of the contents, documents and graphics are maintained.

SIGNE is expressly credited as the source and origin of same.

The purpose of such use must be compatible with the aims of the Website and/or the activity of SIGNE.

That no commercial use is intended, the distribution, public communication, transformation or decompiling thereof is strictly prohibited.

Any other use must be communicated and authorised by SIGNE expressly and in advance.

 

With regard to third party products and services, SIGNE recognises the corresponding industrial and intellectual property rights, and their mere reference or appearance on the Website does not imply the existence of any rights or responsibility whatsoever over same, nor does it constitute any support, endorsement or recommendation of same.

 

Conditions of Use of the Website

3.1 General

 

The Users are obliged to make correct use of the Website in accordance with the Law and the current Legal Notice. The User who breaches the Law or this Legal Notice shall respond to SIGNE or third parties for any damages that may be caused as a result of breach of said obligation. Furthermore, in the case of total or partial non-compliance with the Conditions of Use on the part of the User, SIGNE reserves the right to deny access to the Website with no requirement to provide the User with prior notice.

 

The use of the Website for purposes injurious to property or interests of SIGNE or which in any other way overloads, damages or renders inoperable the networks, servers or other IT equipment (hardware) or IT products and applications (software) of SIGNE or of third parties.

 

3.2 Elements of the Website

 

The Users of the Website commit to use the Elements referred to in section 2 in accordance with the Law and the present Legal Notice, along with the other regulations, conditions and instructions that may apply to certain services that may be provided through the website.

 

3.3 Information provided by the User

 

All the information the User provides through the forms on the Website for the above purposes or any others must be correct and truthful. To these effects, the User guarantees the authenticity of all data provided and shall maintain the data fully up to date. In this case, the User shall be solely responsible for any false or inaccurate declarations they make, and the damages caused to SIGNE or third parties by the information provided.

 

3.4 Introduction of links on the Website

 

Internet Users of providers of Information Society Services on the Information who want to include links from their own websites to the Website must meet the conditions detailed below:

 

The link shall only lead to the home page or main page of the Website but cannot reproduce it in any way (online links, copies of texts, graphs, etc.) Web 2.0 type interaction systems are an exception from the above, offered from the Website to link to it from social media.

In accordance with the applicable legislation in force at each moment, it is prohibited at all ti9me to establish frames of any kind that wrap the Website or allow for its Elements to be viewed through addresses other than those of the Website and in all circumstances in which they are viewed with contents external from the Website in such a manner that: (i) produces, or may produce, error, confusion or mislead users as to the true source of the service or the Elements; (ii) constitutes an act or unfair comparison or imitation; (iii) serves to take advantage of the reputation of the brand and prestige SIGNE; or (iv) any other form prohibited by the legislation in force.

The page containing the link must not contain any form of false, inaccurate or incorrect declaration about SIGNE, its partners, employees or members on the quality of the services offered to users.

Under no circumstances shall it be expressed the page hosting the link that SIGNA has provided its consent for the inclusion of the link or that it in any way endorses, collaborates with, verifies or supervises the services or same.

It is prohibited to use the trademark, graphic or mixed brand or of another distinctive emblem of SIGN except in the case permitted by law or where expressly authorised by SIGNE and provided that, in these cases, a direct link to the Website is permitted in the form established in this clause.

The page that establishes the link must faithfully comply with the law and may not, under any circumstances, avail of or link to own or third-party content that: (i) is unlawful, harmful or contrary to morals or good taste (pornographic, violent, racist, etc.); (ii) induces or may induce in the User the false impression that SIGNE backs, adheres to or in any way supports the ideas, statements or expressions, legal or unlawful, of the website hosting the link; (iii) is inappropriate or not relevant to the activity of SIGNE, in light of the location, content and theme of the website hosting the link.

 

3.5. Change in Conditions of Use

The conditions and terms compiled in this Notice may vary, therefore the User is invited to revise these terms when they visit the Website again or, where applicable, when they request a new service or product.

4. Quality of the service

 

Access to the Website does not imply the obligation on the part of SIGNE to guarantee the total absence of viruses, worms or any other third-party harmful IT element (“malicious software” or “malware”) when browsing. The User shall be responsible at all times for the availability of the correct tools for the detection and disinfection of harmful IT programs.

 

SIGNE shall not be responsible for the damages caused to the User’s or third parties’ IT equipment by the acts of third parties during the provision of the service of the Website.

 

4.1. Quality of the service

 

Access to the Website requires the services and supplies of third parties, including transmission via telecommunications networks whose reliability, quality, security, continuity and functioning is not the responsibility of SIGNE. Consequently, the services provided through the Website can be suspended, cancelled or rendered inaccessible, prior to or simultaneous with the provision of the service of the Website itself with no need for prior notice to be given on the part of SIGNE.

 

SIGNE shall not be responsible for the damages of any kind suffered by the User caused by faults or outages in telecommunications networks leading to the suspension, cancellation or interruption of the service of the Website during the provision of same or prior to same.

 

4.2. Contents and services linked from the Website

 

The Website may include links that allow the User to visit other Internet Pages (hereinafter “Linked Sites”). In these cases, SIGNE acts as the provider of intermediary services in accordance with Article 17 of Law 34/2002, of 11 July, on eCommerce and Information Society Services (hereinafter “LSSI” as per the Spanish) and shall only be responsible for the contents and services supplied on the Linked Sites insofar as it has effective knowledge of the unlawful nature thereof and fails to disable the link with due diligence. In the event that the User considers there to be a Linked Site with unlawful or inappropriate contents, they may inform SIGNE, although under no circumstances shall this report constitute an obligation to remove the link in question.

 

Under no circumstances shall the existence of Linked Sites constitute the existence of agreements with the managers or owners of these, or the recommendation, promotion or identification of SIGNE with the statements, contents or services provided. Nor shall SIGNE be responsible for the functioning of the Linked Sites or possible damages that may arise from the accessing or use of same.

 

SIGNE is not familiar with the contents and services of Linked Sites and therefore is not responsible for damages arising from the unlawful nature, quality, unavailability, error or uselessness of the contents and/or services of the Linked Sites or any other damages not directly attributable to SIGNE for its own services.

 

4.3. Third-party content hosted by SIGNE

 

The Website includes or may include the option for Users to post comments regarding the services of SIGNE or third parties or to participate in any other form by providing opinions and certain information. In these cases, SIGNE acts as the provider of intermediary services in accordance with Article 16 of the LSSI and shall only be responsible for the contents uploaded by other Users insofar as it has effective knowledge of the unlawful nature and fails to remove the unlawful content with due diligence. In the event that the User considers there to be a Linked Site with unlawful or inappropriate contents, they may inform SIGNE, although under no circumstances shall this communication constitute an obligation to remove the link in question.

 

Under no circumstances shall the existence of third-party comments or contents constitute the existence of agreements with the authors thereof, or the recommendation, promotion or identification of SIGNE with the statements, contents or services provided.

 

4.4. The confidentiality of information transmitted via the Website

 

SIGNE has adopted the security measures legally required to guarantee the confidentiality and secrecy of the personal data that Users provide on the Website. Notwithstanding the foregoing, the transmission of said data to SIGNE is via telecommunications networks not controlled by SIGNE. In addition, the existence of malicious software on the equipment may lead to said information being resent or recovered without knowledge.

 

SIGNE shall not be liable for the lack of confidentiality of the information transmitted via third-party telecommunications equipment and networks or for the software or hardware vulnerabilities of the Users’ own equipment.

Law and Jurisdiction

 

All questions that arise between SIGNE and the User relating to the interpretation, compliance with and validity of this Legal Notice shall be governed by the clauses thereof and, where not provided for therein, in accordance with Spanish legislation, with the parties expressly submitting to the Courts and Tribunals of the domicile of SIGNE.
